摘　　要：刑罚轻缓化的效益价值是通过分析国家动用刑罚所付出的成本来评价刑罚轻缓化的实施条件与预期效果。刑罚的效益价值是社会经济与刑事法律发展的共同诉求,是保障刑罚及时性的要求和科学评估立法的需求。刑罚轻缓化的效益价值在于节约国家刑事司法资源,节省用于维护社会稳定的社会资源。既定法律秩序、法律的生产技术水平和成本与研究开发的弹性以及法律供给的机会成本等因素决定了刑罚轻缓化在我国当前的实现具有先在的推动力和现实的必要性。The benefit-value of the moderating trend of penalty is about evaluating the condition and anticipated effect of the moderating trend of penalty through analyzing the cost of penalty. The benefit value of penalty is the development needs of economy and criminal law, the requirement of penalty and scientific evaluation of legislation. The moderating trend of penalty is good for saving legal source and the source of maintaining social stability. The established legal order, the history and present situation of legislation and the opportunity cost of legal supply show that the implementary condition of moderating trend of penalty is well-rounded.
