摘　　要：中国土地承包经营权由于其自身带着天然的公有制烙印,因此难以表现为完全意义上的民法财产权。这就决定了土地承包经营权能否自由转让问题不是一个可以简单地肯定或者否定的问题,而是一个博弈的过程,其结果是在允许土地承包经营权转让的情况下,又对其转让加以限制。The contractual operation right of land in China naturally has the inherent feature of public ownership and the right is hard to be expressed as the completed property rights in civil law. It means that the issue of exchange can not be affirmed or negated easily, but only can he the middle point, which is to grant the exchange of contractual operation right of land with some limits.
