摘　　要：美国有效遏制和治理矿难的经验主要是在革新监管理念的基础上,采取激励性方式监管企业,并以行政法官制度代替司法程序及时解决矿难纠纷。不仅如此,美国还通过设立赔偿委员会,由国家代理工人索赔。美国的经验启示我国重视激励型监管,并可考虑建立国家代理制度,增强受害工人的索赔能力。The American experience in effectively containing and controlling mine is that the government innovates the ideal of supervision, and the government takes incentive approach to regulate enterprises, and sets up Compensation Commission to help workers claim. So the enlightenment is that the government helps workers claim and the government takes incentive approach to regulate enterprises.
