城镇居民购买农村私房的概括无效及司法矫正——基于裁判法学和法律发现的理论思考

摘　　要：基于我国现行政策,人民法院对城镇居民购买农村私房的合同纠纷一般认定无效,此谓概括无效。而调研表明,其政策适用的社会效果并不理想。"1999依身份禁买令"是以集体经济组织成员的身份、单边利益的保护为基准的,这一方面过度干预了出卖方处分其私房的自由,另一方面也侵害了基于缔约信赖利益的买受方的合同权利,引发了更多的连环诉讼、反悔性诉讼。城市化进程中城乡居民的身份已经逐渐弥合,身份变迁、一户多宅、混合身份的共有财产分割、拼合买卖关系的分离等疑难案件都要求法官对城镇居民购买农村私房的合同认定有效。鉴于司法矫正过程中的漏洞发现和司法规则的生成,我们建议立法者按照"政策—实践—立法"的模式,尽快创设城镇居民购买农村私房的法律规则。In accordance with China＇s current policy,the People＇s Courts generally find invalid the contract disputes over urban residents＇ ownership of private houses in rural areas.Nonetheless,research shows that the social effects of the application of the policy is far from satisfactory.＂The 1999 Ban of Purchase Order in Accordance with the identity＂ stipulates for the identity of being a member of the collective economic organizations and unilateral protection of the interests.This unduly intervenes in a seller＇s freedom to dispose of his private houses,and infringes on the contractual rights of a buyer who relies so heavily on the interests of a contract,triggering a chain of lawsuits or the estoppel of the proceedings.In the process of urbanization,with the change in identity from rural residents into urban ones,difficult and doubtful law cases,such as one household possessing more than one house,the division of the communal property by owners of different identity,and the separation of the rights of the property bought by at least two owners together,require that the judge find valid the contract of urban residents＇ ownership of private houses in rural areas.In view of the discovery of loopholes in the process of judicial correction and the generation of the rules of justice,the paper proposes that legislators formulate the rule of law of urban residents purchasing private buildings in rural areas as soon as possible in the light of the ＂policy-practice-legislation＂ model.
