摘　　要：作为韩国独有的坟墓基地权是一种与地上权类似的物权,关于其概念、性质、基本内容以及其与所有权之间的冲突和矛盾一直是韩国理论界和司法实践关注的焦点。结合立法与司法,对困扰学界的坟墓基地权的概念、性质、内容、产生原因以及效力做出阐释,以求澄清、解决问题。As the South Korea＇s exclusive right ,the right of tomb site is a similar real right with the surface right, its concept, nature and basic content as well as the contradiction with ownership right has always been the focus of the theoretical circle and judicial practice in Repulic of Korea . I intend to combine the factors in lawmaking and the judicature, explain the troubled academic concept, nature, content, sources and validity of the right of tomb site, as to clarify and solve problems.
