摘　　要：土地征收中公共利益的判断应该遵从权利制衡原则、公开透明原则与扩大参与原则;其公共利益的具体判断标准有:受益对象的多少;向社会公众提供公共产品;满足国家的经济、文化、国防等建设目标;土地征收的结果确实能使社会公众受益。由于土地征收行为对被征收人的重大影响,应对土地征收的公共利益进行必要的限制。Criteria and norms of public interests in land expropriation,should observes principles of the balance of rights ,transparency and widely participation. Furthermore,the criteria of public interests includes：the quantity of beneficiary,public goods ,and satisfaction of national economic and cultural construction and national defenses purposes. Land expropriation could benefit the public for sure.However,land expropriation has great influcence on the one whose land have been expropriated.Therefore,we have to make some restrition on the public interests of land expropriation.
