城市农民工子女教育保障的逻辑与路径反思——公民权的视角

摘　　要：从治理逻辑出发,城市农民工子女教育保障不仅仅关系到教育和城市的可持续发展,更关系到三农问题和民生问题的妥善解决;而从公民权逻辑出发,城市农民工子女教育保障则关系到农民工子女完全公民权的实现。公民权是现代国家的基石,城市农民工子女的受教育权是其公民权的内在组成部分,保障城市农民工子女的受教育权是现代国家应承担的责任,而城市农民工子女受教育权的根本保障则在于宪政建设。现代国家应当在立足本国国情的基础上加强宪政建设,切实保障城市农民工子女的公民权。On the one hand, from the viewpoint of governing logic, the educational guaranteeing of peasant workers＇ children is not only related to the sustainable development of the education and city, but also related to the proper solution of the problem of ＂agriculture, countryside and farmers＂ and the problem of people＇s livelihood. On the other hand, from the viewpoint of citizenship, the educational guaranteeing of peasant workers＇ children is related to the realization of the citizenship of them. Citizenship is the cornerstone of modern state. The educational rights is part of the citizenship of peasant workers＂ children, we believe that the educational rights of peasant workers＇ children in the city shall be guaranteed by the modern state. The fundamental guaranteeing of the educational rights of peasant workers＇ children in the city lies in constitutionalism construction. The modern state shall guarantee the citizen rights of peasant workers＇children by means of constitutionalism construction based on its national conditions.
