法治建设的中国道路——自地方法制视角的观察

摘　　要：我国在推进法治建设的过程中,一直着力解决的经济建设中的计划与市场、政权建设中的制度化与非制度化、利益分配上的国家与社会等三个逻辑上相互关联的问题。在解决这些问题的过程中,我国法治呈现出自己具有中国特色的道路,即因为推动经济发展的需要,中央与地方之间建立了权力分工体制,为法治与宪政奠定了一个初步的基础;进而推动了国家政权正规化的建设,建立了系统而完整的国家机构以及国家机构权力运行的法律框架;市场化的经济体制改革促使市场主体与市民社会的发育,与逐渐强大的国家机构体系发生了激烈碰撞。国家一方面面临进一步保护市场主体权利的问题,另一方面,面临着规范国家权力行为的艰巨任务。这三大问题及其解决,勾勒出了我国法治建设的基本路径与框架。As the point of view used in the article presented that in the course of tion of the rule of law in China, Chinese government strives to resolve three logically those are planing and market in the course of economic development, institutionalization promoting the construe- interrelated problems, and non - institutionalization about the conctruction of political power, and the relation between state and society in benefit distribution. In the process of dealing with those problems, Chinese characteristics are existing in the construction of the rule of law, that is due to economic development, the central and the local government have established the system of powers division, which has laid a primary foundation for the rule of law and constitutional polities, promoted the regular development of state power, constructed systematic and integrate national institutions and the legal frame in which national institutions exerting political powers. Market -oriented economic reform has prompted market players and civil society development however it has collided with the increasing powerful system of national institutions dramatically. The government must protect the market players＂ right further while regulating the basic government＇s power and behavior. The abovementioned three problems and their resolutions outline routine and frame concerning the construction of Chinese rule of law.
