摘　　要：非理性维权,是权利主体在一定情景环境中,根据个人的情感偏好和心理状态,以非逻辑思维和冲突行为来表达权利诉求的一种行为方式。其价值性在于:一方面它是权利实践生动活泼的形式,凸显权利实践过程中权利的主体性和个性;另一方面,它对法律的背反具有批判性,推动法律制度以合理性为价值取向不断完善,形成具有时代特征的权利制度和权利文化。The irrational realization of rights a behavior mode that expressed by the subject of rights in the way of irrational thinking and conflict behavior in certain situation and environment. Its value lies in two aspects. On the one hand,it is a form to practice the rights and shows the subjectivity and individuality in the process of realizing the rights. On the other hand,it is critical to the law and promotes the law system to develop its reasonability to form the rights system and right culture with the time characteristics.
