论警察权的性质与特点

摘　　要：警察权不同于行政权,既不是来源于行政权,也不是由行政法规范的结果。警察权需要通过法律表现出来,法律反映警察权,法律规范警察权;规范警察权的部门法就是警察法。警察权是由警察权主体、警察权客体以及警察权的实现手段三个基本要素构成。公共权力是警察权的内在本质,警察权的基本性质是由公共权力决定的。警察权具有执行性、强制性、公益性和义务性等特点。Police power differs from the executive power,neither from the executive power,nor from the regulative results by the administrative law.Police power is incarnated,embodied and regulated by law.The departmental laws regulating police power is the police law.Police power is comprised of three elements：the subject,the object of police power,and the means of enforcing police power.Public power is inherent in the nature of police power;the fundamental nature of police power is decided by public power.Therefore,police power is characterized by its compulsory implementation,enforceability and public welfare.
