城市房屋拆迁中的准公益项目初探——对公共利益的另一种类型化解读

摘　　要：为了保障宪法及相关法律所规定的公共利益能够在城市房屋拆迁中得到正确实施,为了推进我国城市房屋拆迁制度的改革,我们有必要对拆迁项目中的公共利益进行类型化,从而将公益项目界分为一般形态和特殊形态。一般形态的公益项目,是人们通常比较熟悉的纯公益项目;特殊形态的公益项目,则是公共利益与商业利益交织与融合在一起的准公益项目。对于准公益项目必须设置特殊的法律规制:限制商业利益的扩张,保证公共利益的主导作用;设置特殊的补偿标准,保护被拆迁人的合法权益;设置更为严格的法律程序,确保拆迁健康、有序地进行。这样既有利于保护和增进城市房屋拆迁中的公共利益,又有助于识别与排除那些鱼目混珠的伪公益项目。To ensure public benefits stipulated in constitution and related regulations be carried out efficiently during house demolition of cities,and to push forward our reforms on house demolition system,we should classify the types of public benefit during the demolition,thereby defining community projects into common form and special form.The common project refers to the projects for the pure public;special project is such a quasi-community project with mutually mixed interests of public and commercial goals.These quasi-projects must be ruled under special laws and regulations： restricting expansion for commercial benefits to ensure its service for public interests;setting particular compensation standards to protect the valid rights of relocated families;stipulating stricter proceeding in law to guarantee a sound and ordered demolition.These measures will help the protection for public benefit during house demolition and find out false community project as well.
