知识产权滥用对信息资源共享的影响及对策探讨

摘　　要：通过分析我国面临的知识产权滥用情况,从经济、法律、价值取向方面说明其成因。从以图书馆为代表的公共信息机构对信息共享程度的要求、合理保护知识产权对信息资源建设的作用以及知识产权滥用对公共信息机构资源建设的影响等几方面探讨知识产权滥用对信息资源共享的影响,进而提出遏制知识产权滥用、促进信息资源共享的几项措施,包括加强反垄断控制、构建信息资源共享与知识产权保护利益平衡机制等。This paper analyzes the situations of intellectual property abuses in China and demonstrates the causes from the views of economics, law and value. Then discusses the effects of intellectual property abuses on information resources on the following aspects ： demands of library and other public information organizations to information resource sharing, the function of fair intellectual property protection to information resource construction and the effects of intellectual property to the resouee building of public information organizations. The authors further put forward some countermeasues including strengthening anti - monopoly control and establish interest balance mechenisms between information resource sharing and intellectual property protection.
