民法基本原则之“公序良俗原则”的思考

摘　　要：在民事立法和民事活动中,注重公共秩序和善良风俗是非常重要的。市场经济社会中,"公序良俗原则"也自应成为民法基本原则之一,这对于维护社会正义、弥补法律缺陷、保护公民权益等方面都具有重要意义。外国民事立法中大多确立了公序良俗的基本原则。我国在未来的民法中也应把公序良俗原则确定为民法的基本原则之一。It is very important for us to pay attention to public order and kind customs in civil legislation and civil activity. In the market economy, public order and moral should be one of the fundamental principles of civil law. It is significative to safeguard social justice, make up legal deficiencies and protect the rights of the citizens. Many countries have established public order and moral. Our country should also establish this fundamental principle in our civil code.
