网络舆论监督与司法审判互动——以“邓玉娇案”为例

摘　　要：以"邓玉娇案"为视角,分析了网络舆论监督与司法审判之间的相互影响,并且从舆论传播学的角度探讨了如何促进我国网络舆论监督与司法审判良性互动,进而指出二者良性互动的关键在于尊重舆论自由与司法独立的前提下,完善网络舆论监督体系,使得网络舆论监督与司法审判在各自领域各司其职,共同维护社会公平正义。Based on study of the noted individual case （ ＂Deng yu jiao ＂ case）, this article analyzes the mutual influenee between the supervision of public opinion and the judicial trial and points out that it is necessary to establish a healthy supervisory system of public opinion, which is beneficial to achieve the positive interplay. Furthermore, it reveals that the freedom of public opinion and the independence of judicature should be both emphasized. Only if the network supervision of public opinion and the judicial trial perform duties in their own respective domain well, the social justice would be uphold well.
