摘　　要：通过对孤儿作品的定义、形成原因及使用状况进行分析,提出促进孤儿作品公共获取的重要性。在此基础上,参考相关国际惯例、法律规范以及案例。最后结合我国《著作权法》,从孤儿作品的使用许可、其问题的根源、使用孤儿作品的条件、使用孤儿品的报酬、使用孤儿作品的程度等方面提出推进孤儿作品公共获取的5项建议,以期对我国孤儿作品的公共获取方法提供借鉴。According to the analysis about the definition, formation and usage of orphaned works, this paper puts forward the importance of the public accesses to orphaned works. And it consults the related international common practices, legal norm, and classic documentations. Finally, it proposes the following ways to resolve the orphaned works problems based on the Copyright Law of the People＇ s Republic of China ： from the using permission of orphaned works, the origin, the using condition, the using recompense, and the using degree. It＇ s expects that all the analyses above can give some references for the public access to orphaned works.
