摘　　要：司法人性化是现代司法改革的题中应有之义,它的正确实施有利于人权保护和司法公正价值目标的实现,但是司法人性化的泛化必然对司法的公正性提出挑战。司法人性化与司法公正的对立是相对的,二者存在统一的基础。加强人性化的立法、坚守法律的底线、培养司法者的人格素质以及建立科学的评价体系是协调司法人性化与司法公正冲突的有效途径。Judicial humanization is one of the subjects of modern judicial reformation.Its correct implementation can help protect human rights and achieve judicial justice value target.But it is inevitable that abusing judicial humanization should challenge judicial justice.Controdiction between judicial humanization and judicial justice is relative.However they have unified basis.It is an effective approach of coordinating contradiction to strengthen humanized legislation,insist on legal principels,bring up dudges＇personality quality and establish a scientific evaluation system.
