摘　　要：在宏观层面上,文章阐述假冒他人专利罪的认定问题后,在整个专利法体系下,对假冒他人专利行为进行深入剖析,明确非法实施专利行为、假冒他人专利行为、冒充专利行为的具体内涵;在微观层面上,文章分析假冒他人专利罪的准确适用。最后,论述了行为人为"假冒他人专利行为"后专利被宣告无效的法律后果,宣示了刑事诉讼中专利无效宣告程序的法律价值,并具体论述了刑事诉讼中与专利无效宣告程序的衔接处理问题。Based on an interpretation of the identifying issues of patent-counterfeiting crime and an analysis of patent-counterfeiting practice within the whole patent law system, the article clarifies the concrete intension of illegal patent implementation, counterfeit of other＇s patent and patent fabrication, then analyses the accurate application of patent-counterfeiting crime and finally dis- cusses the legal outcome of the declaration of counterfeited-patent nullification after ＂patent- counterfeiting practice＂ judgment, shows the legal value of the nullification declaration procedure in the criminal action, and expounds the connection of the nullification daclaration procedure in the criminal action.
