摘　　要：海域物权制度早已存在,近年才被民法学者所关注。随着对海域物权探究的不断深入,我们发现,海域使用权与土地使用权存在着很大差异,其中最重要的是权利客体不同。海域物权制度对现有物权制度产生了很大的冲击。海域使用权和土地使用权应分别设置,自成体系,共同构成我国的用益物权制度。Sea property system has existed for a long time, but has been concerned about by scholars studying civil law in recent years. With the deep exploration of the sea property, you will find that it generated a lot of the existing property system with impact. This article explores the sea and the right to use a single land use on traditional property rights system with the challenge of benefits as well as the waters of traditional property rights theory of property development, including the right of space theory, set theory and real estate objects to determine the standard theory of suspicion and improved.
