设计施工总承包模式与相关法律制度协调的研究

摘　　要：我国建设法律体系是建立在设计与施工分离模式上的,与设计施工总承包模式并不适应。针对运作设计施工总承包模式所涉及的法律关系进行分析,探讨其不适应的方面,并提出修改相关法律制度的若干建议,使之相协调,以促进设计施工总承包模式在我国的应用。At present,the entire construction law is fit for the operation of design-bid-build （DBB）model,which could do harm to construction projects by design-build （DB）delivery system.When choosing the DB model,much attention should be paid to some specific jural relations and legal affairs that may lead to confusions and conflicts a- mong the parties in project environment.It＇s very important to find various legal issues that go against the develop- ment of DB model and provide the resolutions that are useful for promoting the DB model for the industry players.
