摘 要:公立中小学校教师聘任合同建立的基础是教育行政法律关系,首要目的是推行国家教育政策、维护教育公益、实现教育目的。为保证该目标的实现,必然要求教育行政部门和(或)学校享有包括监督和指挥合同履行权、单方变更或解除合同权、对违反合同规定的教师的制裁权在内的行政优先权。而行政优先权的存在又必然使教育行政部门和(或)学校处于与教师地位不平等的状态。如若不通过立法对教师聘任合同行政优先权进行合理控制,必然导致权力腐败、专横以及合同的失控。必须从教师聘任合同行政优先权的内容、程序以及法律救济三个方面进行有效的控制,在充分保障社会公益的基础上,确保教师合法权益的实现。Based on the legal relationship of education administration,the teacher appointment contract chiefly aims at accomplishing the national education policy and maintains public interest.To ensure the fulfillment of those purposes,it is then inevitable to endow the government and schools with the power of intendance and command of contract,the power of unilateralism alteration and free from contract,the power of cracking down teachers who may breach the contract.The status between the government or schools and the teachers are then unequal,which is easy to give rise to corruption,peremptoriness,and losing control of the contract if there is no reasonable guarantee in legislation.It is therefore necessary to regulate effectively the content,procedure and the legal remedy of the power of administration priority in teacher appointment contract,so as to ensure the fulfillment of public interest and teachers' rights.
