对《奥林匹克标志保护条例》的审视与思考

摘　　要：对《奥林匹克标志保护条例》进行了全面审视,在肯定《奥林匹克标志保护条例》现实作用和重要意义的基础上,详细探讨了奥林匹克标志保护是否为我国的"国际义务"、奥林匹克标志权利属性认定、《奥标条例》融入我国法律体系、标志和权利人有关疑问、奥林匹克标志侵权救济途径等问题。认为《奥标条例》需要完善。但从现实需求和有关理论发展水平方面考虑,目前并非修订《奥标条例》的最佳时机,2012年或2016年奥运会之后考虑修订《奥标条例》才比较实际。在此之前应密切关注国际奥林匹克运动的发展、知识产权法的发展和我国体育事业的发展,不断加深有关理论和实践问题的研究,逐步积累奥林匹克标志保护经验。Through a comprehensive inspection, based on analysis of the important role of Regulations on the Protection of Olympic Symbols, problems were discussed as whether it was China＇ s international obligation to protect Olympic symbols, what was the right nature of Olympic symbols, how Regulations coordinated with other laws ; also problems concerning symbols, obligees, tort relief of Olympic symbols were explored. It is believed that Regulations need to be revised, but now is not a proper time by considering theory and practice, it is practicable to do that in 2012 or in 2016 after Olympics. Prior to this we should fo- cus on the development of international Olympic movement, the improvement of intellectual property rights and our sports development, and constantly study issues both in theory and practice, accumulate the experience to protect Olympic symbols.
