摘　　要：2003年出台的《婚姻登记条例》刻意去掉了原有的"管理"二字,以展现其立法定位是服务于民,大大弱化了婚姻登记机关的管理职能,而强化了登记当事人的自由和权利。近几年来,现实中的各种违法婚姻登记现象有增无减,这与管理的软弱、法律责任的缺失不无关系。本文结合现实分析了婚姻登记的性质,就婚姻登记审查权限、登记程序设计等方面的进一步完善提出了建议。The current ＂ regulations of marital registration which came into effect in 2003 removes the word ＂management＂ intentionally to show that the law is to provide services.The management function of marrital registration department is greatly reduced, while the freedom and rights of registration parties are enhanced. The variety phenomenon of illegal marital registration increased in recent years,which was related to the weakness of management and the lack of legal liability. Combined with real,this paper reflects on the property and designation of marital registration,and advances its systematical opinions about further improving of the system of registration of marriage.
