论中国传统法律独立性的缺失

摘　　要：法应具有其内在的精神内核以确证它的价值追求,应具有强制力以保证其实施,应具有一定的约束范围和对象以实现它的意志力,应具有丰富的内容和严密的程序使其能发挥实际功效,然而,中国传统的法律却由于种种原因而被肢解和挤压,这主要表现为中国的"德"抽去了法的合理内核使法的自我发展失去了内在精神动力,君权和行政权对司法权的侵吞使法失去了独立发展的空间,民事调解和家族法也在进一步挤压国家法调整的范围,礼取代了法的程序成为维护封建社会等级秩序的有效手段,"忌讼心态"和"以刑去刑"法制理念却在消融着法的存在。要想拯救中国传统的法,使它恢复曾经具有的生命活力,就要恢复法的应有内核,为它的发展提供一个独立的环境和空间。The law should have its inherent spirit of the core in order to confirm the pursuit of its value,should have the coercive power to ensure its implementation,should have certain scope and object to achieve its will,should have a wealth of content and tight procedures to enable them to play the actual effectiveness,however,for various reasons,Chinese traditional law have been dismembered and extruded,which is mainly embodied by the fact that Chinese ＂virtue＂ takes away the reasonable core of law making the spiritual power lost the ability of internal self-development,the monarchical and executive power embezzles judicial power making the law lost the independent space for the development,civil mediation and family law are to further reduce the scope of the adjustment of national law,the procedure of law has been replaced by rite as a effective means to maintain the hierarchical order of feudal society,the concept of the rule of law about ＂the mind of fearing lawsuit＂ and ＂using criminal punishment to dispel the criminal punishment＂ ablates existence of law.This is the Chinese ancient law,the fragmental law,a law only with a harsh penalty,unjust but only a body of law.Wanting to save the Chinese traditional law and making it to restore the vitality of life,it is necessary to restore the core of law to provide an independent environment and space for its development.
