析中国环境执法的现状与完善

摘　　要：环境保护法的生命力在于它在社会生活中的具体实施。环境执法是最广泛、最普遍的落实环境保护法律的活动。环境执法使环境保护法律在社会生活中的各个领域发挥作用,使国家经济、政治、文化、社会公共等事务朝着有利于环境保护的方向依法进行。它对于加强环境保护的基本国策地位,维护公众环境权益,构建和谐社会等方面都具有重要的意义。随着国家对环境保护的日益重视,我国的环境执法在坚持依法行政、强化环境监管等方面取得了重大的进展,但是也存在不少问题,比如执法机制不完善、执法权限分配不合理、执法效果不理想等。通过借鉴国外环境执法的有益经验并结合我国环境执法的三项基本原则以及地方环境执法的实践,提出若干完善我国环境执法的建议,如完备环境执法机制、合理分配环境监管权限、提高环境执法效率等,以期强化环境执法,实现环境保护法的目的,促进经济和社会的可持续发展。The life-force of the environmental protection law depends on its actual enforcement in our social life. The environmental law enforcement is one of the most broadest and the most common activities by which the environmental protection law is to be put into effect. Environmental law erforcement brings the environmental protection law into our social life and promotes national economy, polities, euhure and social public a flairs developing in progress with the environmental protection. It has far-reaching significance in consolidating the position of environmental protection as a basic state policy, defending the public environmental rights and interests, and building a harmonious society. Although China＇ s environmental law enforcement made great progress in continually porformming official duties according to law and strengthening environmental supervision and administration, some problems still exist, such as the defects of the legal system, the inproporiate division of authority and the lower efficiency of enforcement. These problems can be resolved by absorbiug experience in foreign countries, being integrated with the three basic principles of environmental law enforcement and the local practice in China to realize the goal of the environmental law and to promote the economic and social sustainable development.
