摘　　要：我国刑法第196?条第3?款规定:"盗窃信用卡并使用的,依照本法第二百六十四条的规定定罪处罚。"?可见我国现行刑法对于"盗窃信用卡并使用的行为"以盗窃罪定罪处罚。但是目前关于行为人盗窃信用卡并使用的行为如何定性,无论在理论界还是实务界都存在着很大的争议。According to Item 3,Article 196 of Criminal Law of China：＂Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions in Article 264 of this Law.＂ It is obvious that ＂the action of stealing credit card to use＂ should be punished by theft crime.But there are disputes in theory and practice that how to conform the action of stealing credit card to use.
