摘　　要：著作权刑法保护已越来越受到各个国家和地区的重视,而刑事法律中有关侵犯著作权犯罪的刑法规定明显影响著作权保护力度。我国大陆与台湾地区目前都很重视对侵犯著作权犯罪的刑事处罚,但二者相较,两岸侵犯著作权犯罪立法特点和罪名、犯罪构成、刑事追诉以及刑事处罚上各有千秋。通过比较,大陆应借鉴和吸收台湾地区有关侵犯著作权犯罪的先进之处,以便加大对著作权的刑法保护。Greater attention has been paid to the criminal law of the copyrights in recent years, the stipulations about the violation of the copyrights crime obviously have great effect in the protection power. Both the Main- land and Taiwan are paying greater attention to the criminal offences in violating the copyrights crime. But there are some differences in legislation features, charges, criminal constitution, criminal suits and criminal offences after the comparative study on both sides of the Straits. It is suggested that the Mainland should get the experience from Taiwan so as to give a much better protection to the criminal law of the copyrights.
