摘　　要：我国自上世纪80年代中期开始发行彩票,在为社会公共事业筹集了大量资金,取得巨大社会效益的同时,彩票的规模越来越大、品种越来越多,可以说彩票市场已经蓬勃发展起来了。但同时,彩票市场也存在着管理混乱、弄虚作假、使用不明等诸多问题。制度的不足是其根本原因。我国目前规范彩票业的规范性文件都是一些行政法规、部门规章。可以说,制定一部系统、全面、完善、操作性强的《彩票法》已经成为了当务之急。本文从《彩票法》立法的必要性及其法律属性方面进行了论述。Since mid -1980s the lottery tickets have been issued in China.While raising a lot of money for the public utilities and gaining tremendous social benefits,the size of lottery tickets was increasing with more and more species.It can be said that the lottery market has been booming developed.But at the same time, there are management confusion, deception,unknown use and many other issues in lottery market.The shortage of the ystem is the fundamental reason. China＇s current specification documents those standardize the lottery industry are some of the administrative regulations and departmental rules.It can be said to develop a systematic comprehensive, complete and operable＂Lottery Law＂has become a top priority.This article discussed from the necessity of legislation of＂Lottery Law＂and its legal property.
