摘 要:2008年,金融危机横扫世界各国,我国企业也受到重创,一些企业在危机中倒闭,一些企业则八仙过海各显神通,采取各种措施开源节流以渡过危机,裁减员工便是其中的一个环节。但是依据我国的劳动法律,裁减员工的条件和程序都有严格的规定,操作不慎会给企业带来巨大的用工风险。企业减员增效有以下几种方案:协商解除劳动合同、末位淘汰、待工放假、开除辞退、经济性裁员。通过对每种方案的适用的条件、程序和实务操作、风险控制的全方面的分析,以期对用人单位的实务操作和风险控制有所裨益。In the year of 2008, finance crisis assaulted all over the world, some corporations bankrupted, some corporations reduced cost by all the means,one means is to lay off employees. But according to our labor laws,to lay off employees in corporations is subject to strict conditions and procedures, otherwise it will bring about a big risk. This paper provides some methods of laying off employees, for example, negotiating to release labor contract, the pergraded last in the performance evaluation will be laid off from his position, giving the laborer a vacation to wait for work, dissolve labor contract unilaterally by corporation, and economic dismissal. This paper also analyses their applied conditions, procedures, operational methods and risk control so as to benefit corporations.
