摘　　要：马六甲海峡既是全球重要的咽喉要道,更是中国的海上石油生命线,中国进口原油的85%左右都必须通过马六甲海峡。然而,我国对该海峡几乎没有军事影响能力,一旦马六甲海峡受阻,中国将面临能源中断供给的危机,由此形成的"马六甲困局"成为中国能源安全的潜在威胁。目前,美国、日本和印度都在逐渐加大对该海峡的政治、经济和军事渗透,高度重视马六甲海峡问题,从政治、经济、军事、法律等多方面进行专项研究是维护我国国家海上安全利益的必然要求,而目前国内的研究还不成体系,本文试从马六甲海峡所处的法律环境角度作初步探讨。The Strait of Malacca is not only the world＇s major strategic passage,but also the lifeline of China＇s offshore oil.85% of China＇s exported crude oil must pass through the strait.However,we have little military effect on the strait.Once the strait is blocked,China will face a crisis of energy supply interruption,thus forming the ＂Malacca dilemma＂,which will become a potential threat to China＇s energy security.Currently,the U.S.,Japan and India are gradually increasing their political,economic and military penetration in the strait.Therefore,conducting the special research from the perspectives of politics,economy,military and law is required so as to maintain China＇s maritime security interests.Since the present domestic study on this issue is unsystematic,this article tries to make a preliminary probe from the angle of legal environment of the Strait of Malacca.
