摘 要:古老的中国文化与西方文化是迥然相异的两种文化类型,从某种意义上说,中国自古以来是缺乏西方这种理性文化的,由此造成了中西法理念的巨大差异,西方的理性精神主要是逻各斯和努斯精神的辩证统一,而中国的理性主要是两个单词的组合即理和性,用理来教化性,以形成以忠孝为皈依以名分为人定位的宗法礼教制度。其实这两者的根本差异在于对人、人性、人格的认识的差异:西方强调人以及人格的独立性,人的自我决定性,倡导自我意志;而中国强调人以及人格的依附性,人的被决定性,最后是取消自我意志。Old Chinese culture and Western culture are to different types of culture.To some extent,China always interprets the concept of reason in a different way than the west,which result in the great difference of their ideas of the law.The western concept of reason mainly constitutes the dialectical relationship between the spirit of Logos and the spirit of Yanus;while the Chinese concept of reason is the combination of the two characters of Li and Xing,as a translated term of the word reason.Li means reason and Xing means feeling.With reason employed to guide human feelings,the traditional model of patriarchal system of rites came into being with faithfulness and filial piety as the core of moral codes and the names and positions as the standard for the ranks of men.In fact,the essential difference of the two cultures lies in the cognitive difference of humans,human nature and human personalities.While the west emphasizes independence of humans,human personality,and self-decisiveness of humans,promoting the will of the self,the Chinese tradition emphasize humans with their interdependence,the passivity of human personality,and then finally canceling the will of the self.
