河南省农村土地使用权流转的现状及政策建议——以鄢陵县为例

摘　　要：在河南省农村土地使用权流转方面,鄢陵县颇具代表性。根据调查,目前鄢陵县农村土地使用权流转形式主要有联合出租、自行流转、转让承包、互换经营、股份合作等;流转过程呈现出流转需求增加、进程加快,流转梯度化,流转主体多元化等特点。但农村土地流转过程中也存在流转行为不规范、私自改变土地用途的现象以及农业企业研究市场、扩大效益的任务繁重等问题。加快河南省农村土地使用权流转进程,需采取以下政策措施:以法律的形式确定农村土地所有权与使用权的永久分离;改"承包制"为"永包制";建立有形市场,规范市场运作;改革"普惠制"的农业补贴办法。Yanling county is the most typical in the transfer of rural land use right in Henan province.The result of an investigation shows that the forms of the transfer of rural land use right in Yanling county at present include combined lease,free transfer,sublease and contract,land exchange and stock coperation.The transfer process is typical of increased demand,accelarating process,gradient distribution and the main transfer part’s turning into diversity.However,problems such an non-standard behavior,unauthorized changes in land use and rural enterprises’ heavy task of studying markets and expanding benefit exist in rural land tranfer.To accelerate the transfer of rural land use right in Henan province,we should take the following measures：determination of the eternal seperation of land ownership from land use right in the form of law,changing＂contract systerm＂ into ＂permanent contract system＂,establishing tangible markets and regulating the operation of markets and reforming universal agricultural subsidies.
