摘　　要：在医药技术、医药经济和公共健康问题倍受关注的今天,药品专利保护的双面刃性质已成为国内外学界和产业界关注的焦点。在对药品专利保护与公共健康的关系进行实证分析后的结果显示:药品专利保护随着公共健康水平的提高起初降低然后提高,两者呈U型关系,此拐点的DALE值为51.222年,药品专利保护强度为2.172。Nowadays, as medical technology, medical economy and public health issues having become major concerns, the double-edged sword nature of drug patent protection has attracted the eyes of domestic and foreign academic community and industrial community. This paper makes empirical analysis on the relationship between drug patent protection and public health. The results reveal that the drug patent protection level decreases first with the improvement of public health, and then enhances. The relationship between drug patent protection and public health presents a U-shape, where the DALE value of this inflection point is 51. 222, and strength of patent protection 2. 172.
