摘　　要：研究高深学问，传播知识、创新知识与服务社会乃大学之使命。法治大学诉求的法治建构，旨在保障大学使命的实现。大学使命赋予大学学术研究自由，而大学自治乃学术自由的制度保障，这既是大学的理想所在，也是赖以确保学术自由的命脉所在。法治对大学使命的保障首先体现于宪法保障的学术自由，其基点则是作为学术白由制度保障的大学自治。为此，法治大学的制度安排则须从两个方面考量：一是宏观的大学外部法律制度建构，涉及文化、政治、经济三种力量间的关系，具体规定大学与国家和社会的关系；二是微观的大学内部法律制度构建，涉及大学内部成员的权利保障，关系大学内部的具体运作，其核心在于法律对以学术自由为保障的自治制度的确认和认可。因此，法治大学即为外在的法律制度与内部的自治制度之整合的一种治理形态。The mission of university is researching profound knowledge, disseminating knowledge, innovating knowledge and serving the community. The law-governed construction appealed by law-governed universities aims at guaranteeing the implementation of university mission. The academic research freedom entrusted by university mis- sion and the university autonomy is the systematic protection of academic freedom, which is not only the ideal of u- niversity, but also the lifelines of ensuring academic freedom. The guarantee of the rule of law to university mission firstly embodied in academic freedom guaranteed by constitution, its basic point is the university autonomy which as systematic guarantee of academic freedom. For this purpose, the institutional arrangement of law-governed universi- ties must be examined and weighted from two aspects ： first, macro external legal system construction of university, which involves the relationship between culture, politics and economy, it specified the relationship between uni~,er- sity and nation and society ; second, micro internal legal system construction of university, which involves the rights protection of internal member and concerns the internal specific operation of university. Its core is the recognition and accreditation of law to autonomy which guaranteed by academic freedom. Therefore, law-governed university is a pattern of governance modality which integrates external legal system and internal autonomy.
