摘　　要：电子合同的易改动性和非证据性严重影响了其广泛应用和网上交易的公平性与安全性。为了监管电子商务交易行为、获取经济数据并提供合同公共服务,该文提出在制定电子合同规范的基础上构建电子合同监管与公共服务平台,以第三方形式对电子合同进行监管并提供公证等服务的解决方案。该平台为电子合同签约方提供安全的电子合同备案、分发和统计分析等服务,辅助工商管理机构发现假冒伪劣产品交易、非法主体经营和交易欺诈等行为。平台采用面向服务的架构实现,具有良好的需求适应性和构件的可重用性。试运行结果表明,该平台实现了电子合同监管与服务的各项目标。Online business justice and security problems arise due to the lack of effective supervision and related services for e-contracts.This paper presents a system solution to these issues,with an e-contract supervision and public service platform developed to offer secure e-contract backup,distribution and services,such as notary and arbitration to transaction entities,which also helps government to investigate fraud and illegal transactions.The system structure is described in detail from data and business process perspective,with supervision rules defined and modeled into the system using XML schema.A service oriented architecture is used in system implementation to obtain the reusability and flexibility.The platform in test operation verifies the solution correctness.
