后危机时代市场监管体系的法理阐释

摘　　要：后危机时代下,从法理上阐释市场监管体系,对重建新型市场监管体系、解决监管失灵问题具有重要意义。基于市场的扩张和社会的转型,市场监管失灵频频出现,因此,市场经济的正常运转需要伦理基础和法律规制;真正自治的行会、行业协会也可以提供某种程度的自我监管。改进商人伦理,缓不济急。因此,当下立刻就可以做、而且属于政府分内的措施,是重设重建市场监管体系,使之更有效地对公众利益承担应有的责任,切实实现社会和谐,逐步树立以人为本的人文主义精神。Under the post-crisis era,it is important to explain the market supervision system in the perspective of Jurisprudence,which is also benefit to the reconstruction of a new system of market regulation,to deal with the problem of the failure of the market regulatory.As long as the expansion of market and the social transformation from the acquaintances society to strangers,it often happens that the failure of market supervision,therefore,the normal operation of the market economy needs the ethical basis and the legal regulation.At the same time,the real self-government associations and industry associations can also provide a certain kinds of degree of self-regulation.The improvement of the business ethics of the matter is urgent,which can be done immediately but also belongs to the government share in terms of measure is to reset the market monitoring system,to make it more effective to take the proper responsibility to the public interest.Finally it will reach the practical realization of social harmony,and gradually establish a people-oriented culture spirit.
