摘　　要：农村土地问题是当前重要的现实问题,也是学术界研究的热点问题。当前土地问题的关键是对农民地权的保护,协调好公权力与私权利的关系。但目前在农民地权的保护上还存在一些欠缺。这些缺陷既体现在各法律间的协调问题上,也体现在农地的具体权利规定中,同时,在农地征收补偿和宅基地使用权方面也存在一些问题。这就需要对现有法律进行修改和完善,以适应社会转型期对土地问题的要求。Rural land issue currently is an important practical issue and a hot topic in academic circles.We think that the key point is to protect farmers＇land rights and coordinate the public power and private rights.But now there still exist some lacks in the protection of farmers＇land rights.These weaknesses are reflected both in the coordination between the various legal issues and in the provisions of specific rights of agricultural land.In addition,problems are also found in the compensation for exploitation of agricultural land and residential land use rights.We need to modify and improve the present laws to meet the social transformation required on the land issue.
