农地承包经营权流转是破解农地制度悖论的有效路径

摘　　要：稳定农地承包关系是农地制度安排的大局,但农地调整是制度公平的体现和农民利益的选择,我国现行的农地制度安排蕴涵着农地调整的逻辑必然。农地制度稳定与调整的制度悖论解决需要农地承包经营权流转,而农地承包经营权流转必须具备相应的条件。Stability of agricultural land contract relationship is the overall situation of national institutional arrangements,but the adjustment of agricultural land is the embodiment of the fair system and the choice of the farmers＇ interests.China＇s current institutional arrangements of agricultural land contains the logic necessary adjustment of agricultural land.To solve the paradox of stability and adjustment of agricultural land system need to encode the transfer of the franchise for agricultural land contract,and agricultural land contracting right must have the appropriate conditions.
