摘　　要：国家在言论自由中处于何种适当位置是个挥之不去的问题。坚守思想市场的古典自由主义者与坚守配给正义的新自由主义者,已经把这个问题拉向了两个极端。面对认识上越来越大的裂缝,完全有必要从言论与发出言论的资源之关系切入,去挖掘支撑言论的资源与社会成本的关系。通过梳理美国言论自由演进过程,以及国会立法与联邦通讯委员会管制对言论自由的影响,拓展对"红狮案"的分析,我们可从租金消散来审视言论自由中的国家,从这样一个新的角度去理解言论自由,从而冲破价值的泡沫,为言论自由中的国家角色确定一个更加合宜的标准。It is an unavoidable issue that what proper role should the state play in the market of ideas.For years,classical liberals and neo-liberals have been debated on this issue and haven＇t arrived at a final answer until today.Faced with the growing differences in free speech,it is absolutely necessary for us to examine the traditional issue from a brand-new perspective.We could adopt the methodology of the neo-institutional economics,review some typical cases on the First Amendment in the US Supreme Court history,and try to analyze free speech from a view of property rights.Finally,we will get a more appropriate standard to determine the state＇s place in the market of ideas.
