摘　　要：黑社会(性质)组织犯罪是一项严重的刑事犯罪,其与恐怖组织犯罪和毒品犯罪并称为当今世界的三大灾难性犯罪,由于其对国家的政治、经济和社会往往具有很大的影响,各国在制定法律打击和惩治黑社会(性质)组织犯罪时,都倾向于规定有别于普通刑事犯罪的内容,不仅在实体法上规定较重的刑罚,而且在程序法方面也规定了特殊的诉讼程序。但就我国而言,并没有就黑社会性质组织犯罪规定专门的诉讼程序,在实践中不利于对黑社会性质组织犯罪的追诉和惩罚,因此研究黑社会性质组织犯罪的特别程序问题有着深远的现实意义。The Underworld-nature Crimes is a serious crime, which is called disastrous crime in the world with the terrorist organization crime and the drug crime. So, Comparing with the common criminal, the Countries in the world formulate the special regulations to crack down the Underworld-nature Crimes because of the negative influence to the politic, economic and the society. The special regulations include the Substantive laws which provide the more heavy sentences and the Procedure laws which is special for the Underworld-nature Crimes But to China, there is no specific proceeding for the Underworld-nature Crimes, therefore, it is not very effective to control and punish it. That is why the research of the specific procedure makes sense in the society..
