完善土地承包经营权权能的路径研究

摘　　要：从建立现代产权制度和保障农民财产权益两个视角探求完善农村土地承包经营权权能的路径。过去30年土地产权改革过程中,农民对农用地所享有的占有、使用、收益、处分等四项权能都发生了一定程度的演变。概言之,设定于农用地上的土地承包经营权呈现出权能稳定性和安全性不断加强、权能实现形式多样化、权能结构不断完善等三大趋势。目前,土地承包经营权依然面临权能界限尚不十分清晰、权能结构尚不完整、权利交易受到限制等三个方面的挑战。就农用地而言,在坚持农村土地集体所有制性质不变的前提下,明确界定各相关利益主体权益,并完善土地承包经营权权能,优化其权能结构,强化土地承包经营权交换价值,是今后一段时期最务实的农用地产权制度改革路径。The principal purpose of this paper is to figure out practical strategies for enhancing farmer＇s rights on land contracting and utilization with special reference to entitlement bundles,which balance the requirements of modern property rights and the guarantee of the farmers＇ benefits on farmland. Literature review and normative analysis were employed for formulating the strategies. The results show that not only the stability and security of land entitlement have been improved dramatically in the last 30-year land reform,but also clear tendency could be drawn from the diversification of realizing land entitlement as well as optimization on land entitlement structure. In other words,the farmers＇ entitlements on possession,utilization,benefits as well as transaction for farmland have been improved. However,there still exist some challenges on complete land property right reform,such as unclearly defined entitlement boundaries,the incomplete entitlement structure,and limitations on land entitlement bundle transfer. The authors conclude that,with maintaining the collective ownership on rural land as a precondition for reformulating farmer＇s rights on land contracting and utilization,the most practical way is to further complete and optimize its structure,especially to focus on strengthening its transaction value.
