摘　　要：现代科技发展前后延续性日益明显,社会公共利益甚至是人类整体利益均需要知识产权的公开推广,垄断性与公开性之间的矛盾、专有行为的滥用等已经严重影响经济社会发展,以反垄断法来平衡两者关系是极为必要的。The continuity of the development of modern science and technology has become increasingly clear,so social and public interests and even the overall interests of humanity require the public promotion of intellectual property rights.However,the contradiction between monopoly and the openness,and the abuse of proprietary behavior have seriously affected the economic and social development,thus the antimonopoly law is extremely essential to balance the relation of the two.
