软件知识产权保护中的民间力量

摘　　要：软件具有低成本、易复制、可变性强等特征,这使得软件知识产权的保护若仅仅依靠国家权力的强制力是远不够的,我们应该看到民间力量的作用不可忽视。民间力量具有"侵权者"和"创造者"的双重身份,个体的弱势和整体的强势并存,并且在从众心理的驱使下,其作用具有广泛性和潜意识性、不稳定性和不确定性。充分发挥民间力量保护软件知识产权的建议包括:完善软件知识产权法律保护的方式,健全竞争法的规则;加强知识产权意识和运用能力的培养、教育。另外,非常重要的是充分发挥行业利益的民间代表——行业协会的作用,完善其多方面的职能。如此,促进民众知识产权方面的意识、思想和观念的根本改变,方能为软件知识产权提供真正有效的保护。Software is cheap, easily-copied and variable in terms of its features, which makes its IPR protection only by the government more difficult. However, the non-government force plays its dual role in this aspect as ＂infringer＂ and ＂creator＂; individually it is weak but collectively it is strong. With the reaction of ＂foiiowing suit＂, it functions widely, unstably and unconsciously. The paper gives the following suggestions for maximizing its function： There should be further improvement of the legislation and legal protection for software IPR; there should be more effective IPR implementation and awareness. Besides, it is important to bring the full functions of the software association as a non-government force into full play in order to ensure effective software IPR protection with better protection consciousness of the common people.
