当代中国法律文化发展分析——以制度法文化为对象

摘　　要：随着市场经济的发展和全球化趋势的加强,当代中国社会转型呈现出加速的趋势。在这样的背景下,我国法律文化的发展凸显出复杂的特征。作为法律文化组成部分的制度法文化也展示出复杂的发展态势,制度法文化内部各组成部分的不平衡发展是这一复杂态势的重要体现。我们只有认真分析制度法文化内部各组成部分不平衡发展的原因,完善立法、司法等法律制度,增强法律组织机构和法律设施的功能和作用,才能使法律文化由不平衡发展走向协调发展。Recently,the inners of the legal norm culture are lagged in our legal construction.And it mainly consists of two phenomena:the legal norm to the legal rules and the legal instruments to the legal rules because of its respective features and our social surroundings deficiency.It only depends on the integration among the inners of legal norm cultures that can solve this problem.
