摘　　要：仲裁是否也必须遵循严格的证据规则,或者是否必须适用和尊重诉讼证据规则,仲裁理论、立法和实践并未作出明确的回答。国际体育仲裁院作为体育世界的最高法庭,其仲裁规则和庭审实践所展现出来的相对完整和稳定的证据规则成为国际体育仲裁立法和实践的最高尺度。国际体育仲裁院庭审证据规则可概括为:举证重心倒置下的共同举证规则、交叉质询下的查证规则、仲裁庭自由裁量主导下的采证规则。The arbitration theory,the legislation and the legal practice do not tell whether arbitration should follow the strict evidence rules,or to apply and respect lawsuit evidence rules.As the highest court of the sports world,CAS provides the highest scales for the international arbitration legislation and legal practice.The CAS evidence rules can be summarized as the common given evidence rules under inverted given evidence emphasis,verification rules under cross-examination,discovery rules under free discretion of the tribunal of the arbitration.
