论《中国体育法》的处罚与执行悖论

摘　　要：《中国体育法》从一制定开始就具有很严重的硬伤:法律特性不足,可执行度不高,法律功能弱化,司法角色定位错误,行政特色严重,作为大陆法系的中国法律之一,只有原则没有条文,其中有条款与其他法律条文和法律冲突,凸显出它的先天不足和出台的仓促。Chinese Sports Law has many serious problems since its implement ation,such as the lack of legal characteristics,low enforceability degree,weakened legal function,mistaken judicial role,evident administrative feature.As one of Chinese laws,it has only principles without detailed terms.Some of the terms are contradict with the other laws and regulations.All the above prob-lems show its weakness and hasty.
