摘 要:王博文先生在《经济地理》2010年第1期上发表的《法国原产地保护制度对推进我国优势农产品发展的启示——基于法国葡萄酒原产地保护实证分析》一文,其中提及世贸组织TRIPS将"原产地标志"列为"知识产权问题"。本文认为此处的"原产地标志"实际应该为"地理标志",相应的"原产地保护"也应该称为"地理标志保护"。鉴于目前国内外相关专业词汇的普遍误用,为达到学术争鸣和相互切磋的目的,认为首先有必要明确区分地理标志与原产地标记的内涵,在此基础上再指出地理标志在相关特色产品营销中的运用,进而提出目前我国应加紧为东北大豆等非转基因农产品设立"生态地理标志"保护的建议。The article of "Enlightenment From Wine Of Origin System For The Protection In French to Promote The Advantages Of Regional Planning The Layout Of Agricultural Products In China",which states that origin markings are treated as a kind of intellectual property rights in WTO’s TRIPS.But in our opinions,origin markings should be corrected as geographical indications,and the relevant protection of origin should be also corrected as protection of geographical indications.In view of the widespread misuse of the relevant professional words and learning from each other,we think there’s an urgent need to clearly distinguish the differences between origin markings and geographical indications,based on this we then point out the application of geographical indications in marketing featured products,and finally put forward the suggestion that our country should provide a strong protection of "ecologygeographical indications" for our non-genetically engineered crops such as soybeans in the northeast.
