摘　　要：《联合国海洋法公约》第234条——"冰封区域"条款是惟一一项专门适用于北极的海洋环境保护条款,它为北极环境,特别是北极船源污染治理提供了法律依据。但过于原则性的规定使该条款的执行效力大打折扣。本文在对《公约》第234条进行文本解析的基础上,分析该条对于北极海洋环境保护的现实意义以及面临的困境,并在参考先进区域海洋环境保护模式的基础上,提出北极区域海洋环境保护的立法设想。Article 234——＂ice-covered areas＂ clause in UNCLOS——is the only one specifically applicable to the Arctic marine environmental protection.However,the article is so principled that it decrease the implementation force.This paper aims to put forward a series of legislative ideas on the ship-source pollution control in the Arctic waters,which are based on analysis of the value and shortcomings of UNCLOS,and referring to the regional marine environmental protection model.
