浅析反倾销中的市场经济地位认定规则及衍生问题

摘　　要：2016年前,反倾销中市场经济地位问题将一直困扰中国外贸出口企业,成为阻碍中国对外贸易健康发展的瓶颈。欧盟美国市场经济地位认定规则的共同点是都以市场经济为出发点,以价格是否由国家制定条款作为判断市场经济国家的基础标准。反倾销中针对非市场经济国家衍生出替代国制度,市场经济地位认定与替代国信息关系出现新变化。By 2016 market economy status will have perplexed China＇s foreign trade enterprises in anti--dump ing and precluded the sound development of China＇s foreign trade. E. E.C. and U. S. A. share the common grounds in identification regulation of market economy status： the basic standard of whether a country is a market economy country is with market economy as the starting point and whether or not the prices are determined by the state. The surrogate country system has been derived for non-market economy in anti--dumping and there have been changes of information relation between identification of market economy status and sur- rogate countries.
