中国体育产业发展的制约症结及其法律环境建设

摘　　要：中国体育产业的发展与庞大的体育消费市场和丰富的体育竞赛资源严重不符,这与中国是体育产业后发国家有关,更与中国体育产业发展所需的制度环境有关。在中国体育产业的发展中,存在《中华人民共和国体育法》的法律制约、集权式体育"自治"的管理制约、产权界定不清导致的经济学制约、纠纷裁决上的机制制约等4个制约症结。中国体育产业能否迅速发展壮大,与这些制约症结的根本解决紧密相关。从修改现行《体育法》、协调体育"自治"与"法治"的关系、创新体育产业的产权制度、建立完善的纠纷裁决机制等几个方面入手,加强体育产业发展所需的法律环境建设,能很好地解决这些问题,保障并最终促进中国体育产业的发展壮大。China sports industry development and the huge consumer market of sports does not match with rich resources of the major sports competition seriously,this late-sports industry in China is the State,more with the Chinese sports industry to develop the necessary system of environment-related.In the development of China sports industry,there is Chinese People＇s Republic of Sports Law legal constraints,Authoritarian-style sports autonomous management constraints,property rights,caused by ill-defined economic constraints,disputes,ruling on the mechanism of constraints,the crux of the four constraints.The rapid development of China sports industry can grow,and the crux of the fundamental solution of these constraints is closely related.From amend the existing Sports Law,coordinated sports autonomy and rule of law relationship,innovative sports industry system of property rights,establish a sound and several other aspects of the dispute adjudication mechanisms to start.To strengthen the sports industry to develop the necessary legal environment for the construction,can be very good to solve these problems,protect and ultimately promote the development and growth of China sports industry.
