论我国无线电军地双管体制的变革与完善

摘　　要：西方国家无线电管理多实行单轨体制,由独立的电信管制机构来进行包括无线电在内的电信管制。我国无线电原本实行军地双管,但1998年的机构改革打破了这种双管设置。从我国现行宪政格局出发,这种改变必须有人大立法层面的依据,改变后的管理体制可实行工信部主管,在工信部下设独立管制机构,军队仅对军用无线电享有自我管理权。Western countries carry out single-tracksystem of radio management,by an independent telecommunications regulatory agency for telecommunications regulatory,including Radio.My radio had to implement the military and local co-management,however,the institutional reformin 1998broke the co-management.Departure from our current constitutional structure,such change must be the basis for the legislative level of NPC,after the change in charge of the managements ystem can be implemented MIIT,consists of independent regulatory agencies in the MIIT.Army only have the right tos elf-management for military radios.
